Supreme Court orders waiver of sports telecast rule

The Supreme Court ordered on Friday that a private broadcaster holding the rights for this month's one-day cricket series in Sri Lanka need not share the feed with state-run Doordarshan channel.
The directive was issued on a petition by Dubai-based Taj Television opposing a controversial government telecast rule introduced in November. The rule made it mandatory for private broadcasters to share live sports feed, particularly cricket involving the national team, with Doordarshan. Legal battles over telecast rights normally precede almost every major cricket series involving India, world cricket's commercial hub.
The government wants all matches on its free-to-air terrestrial channel because millions of fans in the cricket-mad country cannot afford cable TV. India, South Africa and hosts Sri Lanka will figure in the one-day tri-series to be played from Aug. 14-29. The government waived its rule in January after a petition by Taj Television to the top court against sharing its feed for the lucrative India cricket tests in Pakistan.

The Supreme Court to rule on Ten Sports' plea

All eyes in the sports broadcast business are on the Supreme Court today, as it is scheduled to deliver its ruling on the plea filed by Taj Television, owner of Ten Sports, seeking a directive to pubcaster Prasar Bharati against interfering with the live transmission of the upcoming Sri Lanka tri-series involving India as well.
Ten Sports, which holds exclusive telecast rights to Sri Lanka cricket, will obviously be hoping for a ruling similar to the one it secured ahead of India's tour to the West Indies in early May. The apex court had then ordered that Ten Sports had exclusive telecast rights to the series and need not share it with the pubcaster. The matter will be heard by a Bench of Justice Ashok Bhan and Justice Markandey Katju, the Press Trust of India has reported. The Bench had earlier issued notices to the information and broadcasting ministry and Prasar Bharati on Ten Sports' plea. It is worth noting that Ten Sports' rights to Sri Lanka cricket, which it has held since 1 January 2004, comes to a close on to 31 December 2006.

The Supreme Court notice to Information and Broadcasting Ministry and the Prasar Bharti

The Supreme Court today issued notices to the Information and Broadcasting Ministry and the Prasar Bharti on Ten Sports' plea to restrain the public broadcaster from interfering with its exclusive telecast rights of the forthcoming major cricket, hockey and tennis events.
The channel's plea was against sharing the feed of upcoming tri-series cricket, Champions Trophy and World Cup hockey (men and women), and US Open Tennis. The matter was mentioned by Ten Sports Counsel P H Parekh before a Bench of Justice Ashok Bhan and Justice Markandey Katju which posted it for hearing on July 31. In an application filed in the court, Ten Sports said it has obtained exclusive telecast rights of the above-mentioned sports events on payment of huge money and expressed the apprehension that by virtue of order dated April 5, 2006, Prasar Bharti may insist on the petitioner sharing with it the feed of ensuing hockey events and US Open Tennis tournament. The petitioner said the women's Champions Trophy and World Cup hockey events were not covered by the said order but it included the events in the application by way of abundant caution. By virtue of the recent Downlinking Guidelines issued by the Information and Broadcasting Ministry, Ten Sports said it will also be required to share the feed of the forthcoming cricket tri-series to be played in Sri Lanka between India, South Africa and the host nation from August 14 to 29, 2006. Pointing out that the operation of the relevant part of the said Downlinking Guidelines were stayed on May 9, it requested the Court to pass a similar order with regard to the forthcoming sports events.

Indian Supreme court bars free telecast of Windies tour

India's Supreme court barred the state-run broadcaster yesterday from showing free-to-air live coverage of the national cricket team's tour of West Indies.
India will play five one-day matches and four Tests starting on May 18, and state-owned Prasar Bharti had demanded live coverage from Dubai-based private broadcaster Taj Television, whose Ten Sports unit holds telecast rights for cricket in the Caribbean.
Taj had requested a fee for the feed, which the government said it could not pay. The Supreme Court upheld a petition by Taj barring Prasar Bharti from downlinking the matches.
Last October, the government passed a controversial order making it mandatory for private broadcasters to share coverage of major live sports events, particularly cricket, with Prasar.
During India's tour of Pakistan in January and February, the two broadcasters ended up in court on the issue. They eventually reached a settlement under which Ten Sports provided free highlight packages to Prasar Bharti for Tests, and the state firm bought the live feed for one-day games.

    Ten Sports moves Supreme Court

Ten Sports, which has exclusive rights to telecast the India-West Indies cricket series, on Friday moved the Supreme Court, seeking to restrain the Prasar Bharati from downlinking the live feed of the matches.
A Bench comprising Justices Ashok Bhan and L K Panta posted the matter for hearing on Tuesday, telling Solicitor General G E Vahanvati to seek proper instructions on the issue as the Dubai-based sports channel has declined to provide the link without payment.
The private channel filed an application contending that if the matches of the Test and one-day international series were simulcast on Doordarshan, it will suffer a huge loss.
It said it has sold the distribution rights to Set Discovery Pvt Ltd, which will have the right to license throughout the country.
The channel said if interim relief was not granted to it, the order of the court delivered before the recent India-Pakistan series would become infructuous.
Taj Television Ltd, owner of Ten Sports, had filed the petition seeking stay of the government guidelines making it mandatory for the sports channels to share feed of sporting events of national importance with Prasar Bharati.
The court had allowed the live telecast of Indo-Pak ODIs on DD after an agreement was reached between Ten Sports and Prasar Bharati that latter would deposit in court a sum of Rs 15 crore.
Ten Sports has challenged the validity and legality of the downlinking guidelines terming it as arbitrary without the authority of law.
The sports channel had challenged the Bombay High Court order of December 21, 2005 refusing it any relief. Later the matter pending before the high court was transferred to the apex court.

    England TV deal decision delayed

A decision on who will broadcast live coverage of England's Test series in India will be announced on Thursday.
Nimbus, which paid 352m for rights to India's home matches until 2010, has agreed a deal and will reveal details in a statement on Thursday morning. The series could be shown in the UK on pay-per-view television, with Setanta, Zee TV, Sony and ARY Digital among the leading candidates.
Sky reportedly also remain in the frame for the three-match series. This is despite Nimbus chairman Harish Thawani saying on Tuesday: "There are currently no negotiations with Sky - they finished at the weekend. "We were somewhat disappointed with Sky Sports' offer but we respect the fact they have their own business to run and own budgets." Sky holds exclusive rights to all of England's home games after signing a new four-year deal in 2005, and has shown England's overseas Tests for 16 years.
A Sky Sports spokesman refused to comment, citing a confidentiality clause relating to the negotiations. BBC Radio are providing ball-by-ball coverage of the three matches on Test Match Special, after completing a four-year agreement with Nimbus.

For those of you who live in Canada, Dishnetwork broadcasts much of their programs including Cricket through Bell ExpressVu.
